1. Who we are
This website is operated by Australian Sun Energy Pty Ltd (ABN 38 137 709 294), trading as HOYA Ondol Australia (“we”, “us”, “our”). We supply HOYA Ondol dry-panel hydronic floor heating panels and related system components, prepare panel and pipe layout plans, and can arrange installation.
These terms apply to your use of this website and to every quote and order, unless we agree otherwise in writing. Where a written quote or invoice contains more specific terms, those specific terms apply to that order.
2. Your rights under the Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where these terms say something that conflicts with those rights, your statutory rights prevail.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our Returns and Warranty page explains how to make a claim.
3. Quotes and orders
- Quotes are prepared from the plans and information you give us and are in Australian dollars (AUD), including GST unless stated otherwise.
- A quote is valid for the period shown on it. Prices and availability may change after that period.
- An order is accepted when we confirm it in writing or issue an invoice for it.
- If your plans, room sizes or floor build-up change after we quote, the quantities, layout and price may need to change too. We will tell you before we proceed.
- Product images on this website are for illustration. Specifications are published on each product page and in the documents supplied with your quote.
4. Layout plans and system design
We design the panel layout, pipe routing and manifold positions for your project from the plans you provide. The hydronic design — heat source, flow rates, controls and connections — must be confirmed by your qualified hydronic heating installer before you order. Our layout plans are prepared to support that installer, not to replace their professional responsibility for the heating system as installed.
You are responsible for making sure the information you give us (plans, dimensions, subfloor type and floor finish) is accurate and complete.
5. Payment
Payment terms, including any deposit, are set out on your quote or invoice. Accepted payment methods are shown on your invoice or at checkout. We do not charge a surcharge for choosing a particular payment method unless it is shown before you pay. Goods remain our property until they are paid for in full.
6. Delivery
- We deliver Australia-wide. Freight is quoted separately unless your quote says otherwise.
- Delivery dates are estimates. We will keep you informed of any delay we become aware of.
- Someone must be available to receive the goods, and the site must be safely accessible for the delivery vehicle. Please tell us about any access restrictions when you order.
- Risk in the goods passes to you on delivery. Please check the goods when they arrive and tell us as soon as possible about any damage or shortfall.
7. Installation
HOYA Ondol panels can be laid by someone with practical building experience, following the supplied layout plans and guided by your hydronic heating installer. Manifold, heat pump and boiler connections must be made by a licensed plumber, and electrical work by a licensed electrician, in line with the laws of your state or territory. The HOYA Ondol warranty requires these connections to be made by licensed trades. This does not limit your rights under the Australian Consumer Law.
The suitability of your chosen floor finish for use over floor heating, and its installation and surface-temperature requirements, are set by the flooring manufacturer. Follow their instructions and warranty conditions.
8. Liability
Subject to section 2, and to the extent the law allows, we are not liable for any indirect or consequential loss. Where goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee is limited, where the law allows, to replacing or repairing the goods (or paying the cost of doing so), or supplying the services again (or paying the cost of doing so).
9. Use of this website
The content on this website, including text, images, layout plans and videos, belongs to us or our suppliers and is protected by copyright. You may view and print it for your own project. Please do not copy or republish it without our permission. We take care to keep the information on this website accurate, but it is general information and does not replace advice about your specific project.
10. Privacy
We handle personal information in line with our Privacy Policy.
11. Complaints and disputes
If something goes wrong, please contact us first so we can try to resolve it. If we cannot resolve it together, you may contact the consumer protection agency in your state or territory, or the Australian Competition and Consumer Commission (ACCC).
12. Governing law
These terms are governed by the laws of South Australia. Each party submits to the non-exclusive jurisdiction of the courts of South Australia and the courts that can hear appeals from them.
13. Changes to these terms
We may update these terms from time to time. The version on this page applies to quotes issued and orders placed after its “last updated” date.
